Review a Parking Infringement
If you have received a parking fine (Penalty Infringement Notice or PIN) and you don’t believe that it is correct, you can request a review.
The request must be made before you pay for the infringement.
If the fine is correct but you are having trouble making the payment, you may be able to apply to pay by instalments.
Reasons You May or May Not Be Eligible
In general, Council is unlikely to consider withdrawal if:
- you didn’t know about a parking requirement
- you didn’t believe you were warned about a parking requirement
- you don’t believe you caused any harm
- you don’t believe the infringement was warranted because you were only there momentarily (including briefly parking in a No Stopping or Clearway area)
- you had a delayed medical appointment.
You may be eligible if:
Somebody Else Had the Vehicle
You may be eligible for a review if somebody else was in control of the vehicle at the time, and either:
- they did not have permission
- the vehicle was stolen, or
- the vehicle had been sold.
With your request, you will also need to provide:
- (if you know who was driving): a statutory declaration containing the driver’s full name and address
- (if the vehicle was sold): a statutory declaration containing the driver's full name and address, and you can additionally provide your copy of the Proof of Transfer/Notice of Disposal section of the Vehicle Registration Transfer Application as evidence of the sale of the vehicle
- (if the vehicle was stolen): a copy of the Police report.

Serious Medical Circumstances
You may be eligible for a review if you have experienced a serious medical situation such as:
- an accident
- emergency hospital attendance
- family death, or
- giving birth.
With your request, you will also need to provide:
- evidence (such as a letter from the doctor or hospital), including date and time details on official letterhead.

Mechanical Breakdown
You may be eligible for a review if you have experienced a mechanical breakdown, and:
- you can demonstrate you attempted to stop in a safe location, and
- you moved as soon as possible from the restricted area.
With your request, you will also need to provide:
- evidence (such as tow truck or RACQ receipt, or a mechanical report), including date and time details, and the nature of the incident.

Parking Meters
You may be eligible for a review if you:
- attempted to pay for parking using a parking meter, and
- believe the meter was not working, and
- you reported this to Council.
Withdrawal is unlikely if you:
- made a mistake using a parking machine, such as an incomplete transaction
- did not attempt to use a different parking meter or the TSV Parking app
- did not enter your vehicle registration number (including 15 minute free parking)
- did not pay because a certain payment method was not available, or
- re-fed the meter and parked for longer than the maximum time.
With your request, you will also need to provide:
- evidence of the report that was made, and
- evidence of attempts to pay.

Signs
You may be eligible for a review if you believe a sign was:
- missing
- damaged, or
- faded.
Withdrawal is unlikely if you:
- misread a sign
- didn’t see a sign
- were unfamiliar with the area, or
- claim that insufficient signage was provided.
With your request, you will also need to provide:
- photos clearly showing the surrounding area to identify the location and any damaged signs.

Disability or Loading Zone Parking Permits
If you have a valid parking permit and it was not on display, you may be eligible for a review.
With your request, also provide:
- a copy or photo of the parking permit, and
- proof of identity.

Incorrect Details, or Issued in Error
You may be eligible for a review if you believe there is an error on the infringement, such as:
- the infringement has incorrect details
- the infringement has been issued in error
- the incorrect offence has been stated, or
- any other administrative error.
With your request, you will also need to provide:
- photos or other information as evidence, such as:
- photos of other vehicles nominated as the offender
- a copy of correct registration details on registration certificate, or
- other proof that the offence did not occur.

External Review Options
If you wish to appeal an infringement, or you are dissatisfied with the outcome of the review, there are external review options.
Election for Court Hearing Notification
You have the right to have this matter dealt with by a Court. Before making that decision you should obtain legal advice.
If you choose this option, you must:
- complete an Election for Court Hearing Notification

- give Council a copy the Penalty Infringement Notice and the completed Election for Court Hearing Notice, within 28 days of the date of the infringement.
Queensland Ombudsman’s Office
The Queensland Ombudsman investigates complaints about the actions and decisions of Queensland agencies.
You may make a complaint directly to the Queensland Ombudsman. Please note that the Ombudsman may choose to refer the matter to Council for investigation beforehand.
